TL;DR: Use our service responsibly. We provide AI automation tools, but you're responsible for compliance with outreach laws. We can terminate accounts that violate our policies.

1. Acceptance of Terms

By accessing or using XeClick's services, you agree to be bound by these Terms of Service. If you don't agree, please don't use our services.

2. Service Description

XeClick provides AI-powered B2B lead generation and outreach automation tools. Our services include:

  • Proprietary data scraping and lead enrichment
  • Custom AI agents for automated outreach
  • Workflow automation via n8n integration
  • Revenue optimization audits

3. User Responsibilities

You agree to:

  • Comply with all applicable laws (CAN-SPAM, GDPR, CCPA, etc.)
  • Not use our service for spam or illegal activities
  • Provide accurate information during account creation
  • Maintain the security of your account credentials
  • Not reverse-engineer or scrape our platform
  • Respect rate limits and usage quotas

4. Prohibited Activities

The following are strictly prohibited:

  • Sending unsolicited mass emails without proper opt-in
  • Targeting individuals in violation of privacy laws
  • Impersonating others or misrepresenting your identity
  • Using our service for phishing or fraud
  • Attempting to bypass our security measures
  • Reselling access without authorization

5. Payment & Billing

Subscription fees are billed monthly or annually. All payments are non-refundable except as required by law. We may change pricing with 30 days' notice.

6. Service Availability

We aim for 99.9% uptime but cannot guarantee uninterrupted service. We're not liable for downtime, data loss, or service interruptions beyond our reasonable control.

7. Intellectual Property

All platform code, AI models, data pipelines, and branding are proprietary to XeClick. You retain ownership of your data, but grant us license to process it for service delivery.

8. Limitation of Liability

XeClick is not liable for any indirect, incidental, or consequential damages arising from your use of our services. Our total liability is limited to the amount you paid in the past 12 months.

9. Account Termination

We may suspend or terminate accounts that violate these terms, engage in abusive behavior, or pose security risks. You may cancel anytime, effective at the end of your billing period.

10. Changes to Terms

We may modify these terms with 30 days' notice. Continued use after changes constitutes acceptance.

11. Governing Law

These terms are governed by the laws of the State of California, USA. Any disputes will be resolved in San Francisco County courts.
